AT&T's chief financial officer told the investor relations department to “work" the analysts who had estimates for the company's quarterly equipment revenue that were too high, according to the government's complaint. AT&T investor relations executives Christopher Womack, Michael Black and Kent Evans called Wall Street analysts at about 20 firms privately to tell them about internal smartphone sales data and the impact that would have on its revenue metrics, which the government said is nonpublic, “material” information told in violation of securities laws. Analysts subsequently cut their revenue forecasts because of what they were told on the calls before AT&T reported its first-quarter results in April 2016, according to the complaint, and AT&T’s revenue beat the Wall Street consensus for the quarter. Dallas-based AT&T said in a statement that it did not tell analysts “material nonpublic information" and that it will fight the lawsuit.   • Biden White House: message discipline, no news conference

    WASHINGTON — No news conference. No Oval Office address. No primetime speech to a joint session of Congress. President Joe Biden is the first executive in four decades to reach this point in his term without holding a formal question and answer session. It reflects a White House media strategy meant both to reserve major media set-pieces for the celebration of a legislative victory and to limit unforced errors from a historically gaffe-prone politician. Biden has opted to take questions about as often as most of his recent predecessors, but he tends to field just one or two informal inquires at a time, usually in a hurried setting at the end of an event. In a sharp contrast with the previous administration, the White House is exerting extreme message discipline, empowering staff to speak but doing so with caution. Recalling both Biden’s largely leak-free campaign and the buttoned-up Obama administration, the new White House team has carefully managed the president’s appearances, trying to lower the temperature from Donald Trump’s Washington and to save a big media moment to mark what could soon be a signature accomplishment: passage of the COVID-19 bill. The message control may serve the president's purposes but it denies the media opportunities to directly press Biden on major policy issues and to engage in the kind of back-and-forth that can draw out information and thoughts that go beyond the administration's curated talking points. “The president has lost some opportunity, I think, to speak to the country from the bully pulpit. The volume has been turned so low in the Biden White House that they need to worry about whether anyone is listening," said Frank Sesno, former head of George Washington University's school of media. “But he’s not great in these news conferences. He rambles. His strongest communication is not extemporaneous.” Other modern presidents took more questions during their opening days in office. By this point in their terms, Trump and George H.W. Bush had each held five press conferences, Bill Clinton four, George W. Bush three, Barack Obama two and Ronald Reagan one, according to a study by Martha Kumar, presidential scholar and professor emeritus at Towson University. Biden has given five interviews as opposed to nine from Reagan and 23 from Obama. “Biden came in with a plan for how they wanted to disseminate information. When you compare him with Trump, Biden has sense of how you use a staff, that a president can’t do everything himself,” Kumar said. “Biden has a press secretary who gives regular briefings. He knows you hold a news conference when you have something to say, in particular a victory. They have an idea of how to use this time, early in the administration when people are paying attention, and how valuable that is.” The new president had taken questions 39 times, according to Kumar’s research, though usually just one or two shouted inquiries from a group of reporters known as the press pool at the end of an event in the White House's State Dining Room or Oval Office. Those exchanges can at times be clunky, with the cacophony of shouts or the whir of the blades of the presidential helicopter idling on the South Lawn making it difficult to have a meaningful exchange. “Press conferences are critical to informing the American people and holding an administration accountable to the public,” said Associated Press reporter Zeke Miller, president of the White House Correspondents' Association. “As it has with prior presidents, the WHCA continues to call on President Biden to hold formal press conferences with regularity.” White House press secretary Jen Psaki on Friday defended the president's accessibility to the media and suggested that a news conference was likely by the end of March. “I would say that his focus is on getting recovery and relief to the American people and he looks forward to continuing to engage with all of you and to other members of the media who aren’t here today,” Psaki said. “And we’ll look forward to letting you know, as soon as that press conference is set.” The president’s first address to a joint session of Congress — not technically a State of the Union address but a speech that typically has just as much pomp — is also tentatively planned for the end of March, aides have said. However, the format of the address is uncertain due to the pandemic. The president has received high marks for two major scripted addresses, his inaugural address and his speech marking the 500,000th death to COVID-19. Having overcome a childhood stutter, Biden has long enjoyed interplay with reporters and has defied aides’ requests to ignore questions from the press. Famously long-winded, Biden has been prone to gaffes throughout his long political career and, as president, has occasionally struggled with off-the-cuff remarks. His use of the phrase “Neanderthal thinking” this week to describe the decision by the governors of Texas and Mississippi to lift mask mandates dominated a new cycle and drew ire from Republicans. That created the type of distraction his aides have tried to avoid and, in a pandemic silver lining, were largely able to dodge during the campaign because the virus kept Biden home for months and limited the potential for public mistakes. Firmly pledging his belief in freedom of the press, Biden has rebuked his predecessor’s incendiary rhetoric toward the media, including Trump's references to reporters as “the enemy of the people.” Biden restored the daily press briefing, which had gone extinct under Trump, opening a window into the workings of the White House. His staff has also fanned out over cable news to promote the COVID-19 relief bill. And while Biden’s own Twitter account, in a sharp break from Trump’s social media habits, usually offers rote postings, his chief of staff Ron Klain has become a frequent tweeter, using the platform to amplify messages and critique opponents. Delaying the news conference and joint address also, symbolically, have kept open the first chapter of Biden's presidency and perhaps extended his honeymoon. His approval rating stood at 60% in a poll released Friday from The Associated Press-NORC Center for Public Affairs Research. Tobe Berkovitz, a professor at Boston University’s college of communications, said Biden’s “rope-a-dope” strategy was right for the moment. “Presidential press conferences are not on the top of the agenda for Americans who are worried about COVID and the economic disaster that has befallen so many families,” he said. ___ Lemire reported from New York.   • NY officials removed fuller tally of nursing home deaths

    NEW YORK — Gov. Andrew Cuomo's administration insisted Friday that a quest for scientific accuracy, not political concerns, prompted members of his COVID-19 task force to ask the state health department to delete data last summer from a report on nursing home patients killed by the coronavirus. The Wall Street Journal and The New York Times, citing documents and people with knowledge of the administration’s internal discussions, reported late Thursday that aides including secretary to the governor Melissa DeRosa pushed state health officials to edit the July report so it counted only residents who died inside long-term care facilities, and not those who died later after being transferred to a hospital. At the time, Cuomo was trying to deflect criticism that his administration hadn't done enough to protect nursing home residents from the virus. About a third of the state's nursing home fatalities were excluded from the report as a result of the change. The revelations about the removal of the higher fatality number come as the Democrat also faces accusations he sexually harassed two former aides and a woman that he met at a wedding. Cuomo had apologized Wednesday for acting “in a way that made people feel uncomfortable” but rejected calls for his resignation and said he would fully co-operate with the state attorney general's investigation into the sexual harassment allegations. Federal investigators are scrutinizing his administration’s handling of nursing home data. Top Democrats in the state have said they want those investigations to conclude before they make a judgment about Cuomo's conduct, but in the wake of Thursday night's report, a few state lawmakers renewed calls for the governor to either resign or be ousted. “And Cuomo hid the numbers. Impeach,” tweeted Queens Assembly member Ron Kim, who said Cuomo bullied him over the nursing home response. White House Press Secretary Jen Psaki said Friday that the allegations that Cuomo aides manipulated public reporting of nursing home deaths were “troubling” and said the White House “certainly would support any outside investigation.” The July nursing home report was released to rebut criticism of Cuomo over a March 25 directive that barred nursing homes from rejecting recovering coronavirus patients being discharged from hospitals. Some nursing homes complained at the time that the policy could help spread the virus. The report concluded the policy played no role in spreading infection. The state's analysis was based partly on what officials acknowledged at the time was an imprecise statistic. The report said 6,432 people had died in the state's nursing homes. State officials acknowledged even then that the true number of deaths was higher because the report was excluding patients who died in hospitals. But they declined at the time to give any estimate of that larger number of deaths, saying the numbers still needed to be verified. In fact, the original drafts of the report had included that number, then more than 9,200 deaths, until Cuomo's aides said it should be taken out. State officials insisted Thursday that the edits were made because of concerns about accuracy. “While early versions of the report included out of facility deaths, the COVID task force was not satisfied that the data had been verified against hospital data and so the final report used only data for in facility deaths, which was disclosed in the report,” said Department of Health Spokesperson Gary Holmes. The governor's office didn't respond to questions about whether Cuomo himself was involved in removing the higher death total from the report. Scientists, health care professionals and elected officials assailed the report at the time for flawed methodology and selective stats that sidestepped the actual impact of the directive. The administration refused for months to release more complete data. A court order and state attorney general report in January forced the state to acknowledge the nursing home resident death toll was higher than the count previously made public. DeRosa told lawmakers earlier this month that the administration didn't turn over the data to legislators in August because of worries the information would be used against them by President Donald Trump's administration. “Basically, we froze, because then we were in a position where we weren’t sure if what we were going to give to the Department of Justice or what we give to you guys, what we start saying was going to be used against us while we weren’t sure if there was going to be an investigation,” DeRosa said. Cuomo and his health commissioner recently defended the March directive, saying it was the best option at the time to help free up desperately needed beds at the state’s hospitals. “We made the right public health decision at the time. And faced with the same facts, we would make the same decision again,” Health Commissioner Howard Zucker said Feb. 19. The state now acknowledges that at least 15,000 long-term care residents died, compared to a figure of 8,700 it had publicized as of late January that didn’t include residents who died after being transferred to hospitals.   • Microsoft Server Flaws Raise Alarms at White House, DHS

    (Bloomberg) -- Newly discovered flaws in Microsoft Corp.’s software for email has raised concerns at the highest levels of the U.S. government, which is urging users to immediately apply patches.At least 30,000 organizations across the U.S., including significant numbers of small businesses and local governments, have been hacked via holes in Microsoft’s email software in the last few days by suspected Chinese attackers who are focused on stealing email from victims, the blog KrebsonSecurity reported Friday.“This is a significant vulnerability that could have far-reaching impacts,” said Jen Psaki, the White House press secretary, speaking at a briefing. “We are concerned there are a large number of victims.” She characterized the incident as an “active threat.”Her remark comes after Microsoft disclosed on Tuesday that nation-state hackers based in China were exploiting previously unknown flaws in on-premise versions of the software and released patches for them. The following day, the Cybersecurity and Infrastructure Security Agency, which is known as CISA and is part of the Department of Homeland Security, issued an emergency directive in response to “observed active exploitation of these products.” As a result, civilian agencies and departments were directed to apply the patches, or disconnect Microsoft Exchange from their networks, and to look for compromises.Government concern over the flaws continued to build over the course of the week. On Thursday, CISA released an alert stating that it was aware of hackers using tools to search for servers that hadn’t yet been patched. That evening, National Security Advisor Jake Sullivan wrote on Twitter that the U.S. is “closely tracking Microsoft’s emergency patch.” He cited “reports of potential compromises of U.S. think tanks and defense industrial base entities.”The specific targets and timing of the hacking remains unknown. Defense Department spokesman John Kirby said the Pentagon is assessing its systems based on Microsoft’s advisory. The cybersecurity firm FireEye Inc. found that victims included “U.S.-based retailers, local governments, a university, and an engineering firm.” The version of exchange targeted by hackers is typically run by small businesses, putting them at special risk, according to Allan Liska, an analyst at the firm Recorded Future Inc..A Microsoft representative said the vulnerabilities were disclosed to the company in early January. Microsoft isn’t aware of attacks before then, the representative said.The cybersecurity firm Volexity reported finding attacks leveraging the flaws that date back to as early as Jan. 6.     Jason Spezza would have jumped at the opportunity to voice his support for women’s hockey even if he didn’t have four daughters growing up at home. The veteran Maple Leafs forward was a big fan of the women’s game long before he was married, dating to years ago when Spezza attended a pre-Winter Games tune-up between Canada and the United States at a rink in suburban Toronto. “It was one of the best hockey games I’ve watched,” he recalled this week. “There were 6,000 people packed in the building. And it didn’t matter that it was males or females. It was just a great hockey game.” That memory, coupled with the invested personal interest he has for his children, helped prompt Spezza to be one of numerous NHL players to participate in the Professional Women’s Hockey Players’ Association’s latest campaign promoting the need to establish a new North American women’s league. “I think regardless if I have daughters or not, I think it’s a really important cause,” Spezza said. “But it definitely hits more close to home for me with having four daughters and a wife, and women’s rights and talking about equality, which we talk about quite a a bit about in our house.” Titled “Stick In The Ground,” a one-minute video released last week features U.S. and Canadian women’s national team players, NHL players, tennis great Billie Jean King and even Toronto Mayor John Tory discussing the importance of planting a stick to benefit the future of women’s hockey. As PWHPA executive and Hockey Hall of Fame member Jayna Hefford says in the video: “Every young girl deserves to have the same visible hockey role models as every young boy.” It was a message echoed by Edmonton Oilers forward Kyle Turris, who participated in the video. “I have two sons and a daughter, and yeah, I think it’s important,” Turris said. “I want my daughter to grow up thinking she can run the world if she wants to do as well.” Founded in May 2019 following the demise of the Canadian Hockey League, the PWHPA is made up of the world’s top female players united in a bid to establish a single North American professional league — ideally backed by the NHL — with a long-term sustainable economic model. The association’s members have balked at playing for the U.S.-based six-team National Women’s Hockey League, and instead have been holding a series of barnstorming weekend events called the “Dream Gap Tour.” This year’s tour opened with New Hampshire and Minnesota playing two games, including one at Madison Square Garden on Sunday, which was televised nationally in both the U.S. and Canada. This weekend, the two PWHPA U.S. hub teams will play two games at Chicago, including a contest at the United Center on Saturday that will be televised on NBC Sports Network. The games represent a homecoming of sorts to U.S. national team member Brianna Decker, who grew up a Blackhawks fan in Wisconsin. “I’m super exited to play there,” the two-time Olympian said, adding, “my brothers are definitely jealous.” Decker is particularly impressed by the support the PWHPA has generated from NHL players and its franchises. “Kyle Turris saying he wants his daughter to have the same opportunities as himself, that’s what we’re striving to do,” she said. “Right now, we have college hockey. And if you’re at the elite level, you make the national team. But after college, you’re usually just done playing, which is sad.” Decker played at Wisconsin, where she had more access to resources and training facilities than when she played in either the CWHL or NWHL. “There should be something bigger and better out there for us once you’re done with college,” she said, referring to a dedicated dressing room to being able to do your laundry at the rink. “Those are some little things that we’re striving for, aside from a financial backing.” And that’s where PWHPA members say the NHL needs to step in. The league has provided some monetary support in the past, while also increasing the visibility of top female players by including them in each of the past two All-Star weekend festivities. The NHL, however, has stopped short at committing to back a women’s pro league. Commissioner Gary Bettman has previously said the league is open to establishing a league, but not at the expense of forcing an existing league like the NWHL out of business. Deputy commissioner Bill Daly said the league’s position hasn’t changed. “I think the league and our board are supportive of women’s hockey, period,” Daly wrote in an email to The Associated Press on Friday. “We understand it’s importance to the game generally and the growth of our game going forward. But as you are seeing, that support can (and does) take a variety of forms.” The NHL Players’ Association has also been on board in providing the PWHPA both monetary and organizational support, including attracting corporate sponsors. Timing is becoming an issue, with the PWHPA hoping it can align the launch of a league with the quadrennial boost women’s hockey gains from Olympic competition. The Beijing Games are a year away. “We want the NHL to step in and be like, `We’re going to support your league.'
