Canada bans transgendered air travelers

Due to an obscure amendment to the country's airline screening regulations, Canadian men and women who don't identify with their genetic sex will be prohibited from boarding any commercial aircraft for travel.

It looks like America can finally put a check in the "win" column over Canada for LGBT rights -- at least when it comes to air travel.

Suddenly, flying the gay friendly skies over our neighbor to the north may be athing of the past for its transgendered citizenry. Due to an obscure amendment to the country's airline screening regulations, Canadian men and women who don't identify with their genetic sex will be
prohibited from boarding any commercial aircraft for travel.

Meanwhile, guys like this -- who dress in women's lingerie -- go untagged by the US government's No Fly List, are waved right on through the checkpoint line by the Transportation Security Administration, and are welcomed aboard US Airways (LCC) flights as preferred customers. They may not be able to get married in the majority of our country, but at least we give them the right to fly through it.

Deemed by some to be surreptitiously slipped into the Canadian Aeronautics Act's Identity Screening Regulations was the following clause: "An air carrier shall not transport a passenger... who does not appear to be of the gender indicated on the identification he or she presents." The provision was written back in July 2011 and passed without a Parliamentary or public vote. It went unnoticed by the Canadian transgender community and the news media at large until last week.

Transportation Minister Denis Lebel defended the provision in the interests of passenger "safety."

Sure, because no single group of people poses a greater threat of danger to Canada's national security than the cast of RuPaul's Drag Race.

Let this be an official warning to those jihadists planning another terrorist attack in the air by boarding planes dressed in burqa disguises. The Canadian government is onto you!

    Technically a person who has legally changed their gender would be able to fly, what it would prohibit is those transgenders who have not fully transitioned yet, so that they have not yet had the legal change of their gender made.

    It discriminates primarily against transvestites rather than transsexuals, I suppose. Although, it's a ridiculous regulation, if the person is identifiable in photo id as the person they are, it shouldn't matter how they are dressed. It's not a security risk if someone biologically and legally male is dressed as a woman in their passport photo and identifiable from that id.

    All the discussion surrounds men dressed as women. What about women dressed as men (and I don't mean wearing pants and not a skirt). I mean the total look, haircut, shoes, whole outfit (go to a Melissa Etheridge concert if you don't know what I mean). They identify as men but are probably still genetically female. They are not called crossdressers. Are they going to get kicked off?

    As a transsexual woman, prior to surgery I was advised by my physician that should I ever fly, I should have a letter from him with me to explain my circumstances. While this may now be law, it's always been something that the transgender community and their physicians have kept in the back of their minds. I'm a bit torn on the topic, quite honestly, because if you want to look at it from a technical standpoint, it is "lying" if your passport says one gender while you obviously look to be the opposite. But, a transsexual person MUST live in their chose gender for a minimum of 1 year prior to surgery (which usually takes more than a year to happen with waitlists, etc - it took me 2 years) so that poses a problem, especially since many transsexuals go overseas for gender reassignment. Not only that, gender reassignment is performed at only one place here in Canada, which is in Montreal. So, I can see how it will create major problems. There must be some way to create exemptions.

    'True Soul' read the article it is not just Air Canada, it is all "commercial" air lines. And as for this new rule, in true Canadian fashion it will be reviewed and as always watered down! After all we propose to be the good guys and wouldn't want to offend.

    The title is misleading and people who only read the title will have misconceptions about what's really going on. Transgendered people can still fly. They just have to state what their birth gender is. Nobody's rights are being taken away. You can still be transgendered, gay, or whatever and you can still fly. Just another example of poor journalism.

      It doesn't matter whether you state your birth gender. The rule clearly states that you must APPEAR as the gender you specify:

      "An air carrier shall not transport a passenger... who does not appear to be of the gender indicated on the identification he or she presents."

      For example if you identify your birth gender as male and you appear to be female, you cannot fly.

You are indeed going to be in the bemused spectator's seat in future as fiat regulation from Harper's "minyans" compounds the abrogation of rights in sledgehammer (and often omnibus) legislation. The latest is police monitoring of internet activity and without necessarily the inconvenience of judicial warrant because, in the words of Public Safety Minister Vic Toews, "You can either stand with us or with the child pornographers."

    Well, imagine if you were a female wearing pants and you try to board the plane, and the security people ask you to show them your male ID because they believe that guys wear jeans and girls wear skirts. It will be embarrasing and impossible for this girl to be asked and she would not be able to prove she is a male because she is not. So, will she be refused to fly? ...do you see the problem?, ....now you are thinking...she must be a really ugly girl or making some excuse (what if it was you, It would be a big deal!).... Just because someone put the wrong wording in a legislation doesn't make it right to discriminate. ...we are not safer because of this regulation because it is invalid...it will be struck down because it violates the charter of rights and so it should be fixed because you can't enforce a regulation that is flawed.

    I agree with banning clothes that are related to terrorist. However, transgendered people have rights (or should have rights). They are only doing what they can to survive in this world with how they were born. To ban transgendered persons to fly is TOTALLY WRONG. In many cases, they look very much like the gender that you see. It's only the passport that gives them away. NOT fair. This stupid law will notr be a law for long. This is a human rights violation.
